FAQs
- After having your drivers license revoked a formal administrative hearing may be required to reinstate your license. You must first request a hearing with a letter sent to the Secretary of State's Office. You must then appear at the hearing and testify on tape in front of a hearing officer. You must show at the hearing that you will not be a risk to the public if allowed to drive again.
- An attorney represents the Secretary of State at all formal hearings held for drivers license reinstatement. The attorney, referred to as a prosecutor, is there to ask you questions on behalf of the Secretary of State. The prosecutor attempts to elicit testimony that will determine whether you will be a risk to the public if allowed to drive again. The Secretary of State has an attorney at all formal hearings, shouldn't you?
- Restricted driving permits may be requested prior to eligibility for full reinstatement of driving privileges. If you can show at a formal hearing that you will suffer an undue hardship if not allowed to drive, you may be granted a restricted driving permit. The permit allows you to drive at specific times to and from specific locations.
